Fougett does not guarantee that all items included in the Fougett online store are in stock at the time of your order. In the event that an item is unavailable, Fougett will contact you shortly by phone or by email. Fougett cannot promise that the content of the website is free of inaccuracies or typographical errors at all times. Neither can we guarantee that all information is up to date. Fougett may, at any time, amend the content of the website. Although Fougett strives to display the correct texts, images and pricing on the website and online store, errors may occur. If you have been charged the wrong amount in the online store, Fougett will give you the option of placing a new order with the correct price or cancelling your order. Fougett, however, reserves the right to cancel any order prior to dispatch should we find that the price is incorrect. In such a case we will notify you by email. If we are unable to contact you, your order will be automatically cancelled. Part of the services mediated through the website are maintained by outside organisations. In situations where Fougett acts as agent for such services, we cannot be held responsible for any errors resulting from their activities. Fougett cannot be held responsible for any damage caused from using the website or, for that matter, not being able to use the website. Fougett cannot guarantee problem-free, uninterrupted, and secure access to the website.

The following terms and conditions (“Terms and Conditions”) are the legal terms and conditions under which Fougett Limited (“Fougett”, “us”, “we”) (company number 120990) supplies the products listed on our website () to you. The Terms and Conditions apply to all use of and orders placed on Fougett’s website www.fougett.com (“website”) and via direct contact with our sellers. Our registered VAT number is 376 3313 91.  

By using the website and/or placing an order on the website you confirm that you have read the Terms and Conditions and that you accept to be bound by them. Before you accept the Terms and Conditions you shall also read and understand our Privacy Policy here and Cookie Policy. These Policies form part of the Terms and Conditions.

If you do not accept these Terms and Conditions, do not use our site.

 

Fougett reserves the right to revise the Terms and Conditions at any time. Please note that the Terms and Conditions valid for your order are always the Terms and Conditions that you have read and accepted before you have placed your order and not a later version. You should keep a copy of these Terms and Conditions for future reference.

Please note that Fougett does not guarantee that all products presented on the website are in stock or are available for purchase. Fougett reserves its right to stop selling a product.

The language of the Terms and Conditions is English.

 

 2. Placing an order

Please make sure that you have read and understand the Terms and Conditions before you place an order.

Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until your order has been accepted by Fougett, please see section 5.

If prolonged inactivity causes your connection to the website to fail, your selection of products may be lost. In such a case, you will be required to re-enter your selection of products to the shopping bag.

 3. Preorders 

Items available for preorder appear with the option to "Preorder" rather than "Add to Shopping Bag"; the estimated delivery window for each item is located on the product page beneath the description. When purchasing an item available for preorder, you will be charged immediately. Once your pre ordered item(s) ship, you will receive a shipping confirmation with tracking information.

 

4. Order confirmation

After submitting your order, Fougett will send you an automatic order confirmation via email to confirm that we have received your order and that we will now confirm the availability of the order. Please note that the order confirmation email is an acknowledgement that we have received your order and is not an acceptance of the order. For more information, please see section 5.

5. Acceptance and shipping confirmation

Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose to not accept your order for any reason whatsoever without any liability to you. Non-acceptance of an order may, for example, occur as a result of one of the following situations:

·       The ordered product is out of stock

·       Inability to obtain authorization of payment

·       An error within the product information

·       Suspicion of any fraudulent activity

After you have submitted your order, Fougett will seek authorisation from your bank or card issuer to take payment from your account. Fougett will not process any order until payment has been received in full. If Fougett accepts your order, we will send you an email to confirm that your order is being processed, at which point the contract between us (the "Contract") will be formed.

Once the order has been processed, a shipping confirmation email will be sent with all relevant information about your order. The shipping confirmation is our acceptance of your order.

Please note that Fougett does not guarantee that all products presented on the website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by phone or by email.

If we have already received a payment for the order, we will refund the amount to you.

 

6. Colours

Fougett’s goal is to describe the products on the website as correctly as possible. However, please note that due to the colour settings of your computer, the colours of the products shown in the pictures on the website can differ somewhat from their actual colours. Fougett cannot be held responsible for any such discrepancy.

 7. Prices

The prices on the website are shown in Euro (EUR). No VAT or sales tax is charged on sales within the EU. For products purchased in the rest of the world, the amount of VAT or equivalent sales tax will be displayed separately to the product price and is deductible at the checkout. You must also pay any import or export duties, tariffs or similar costs charged as a result of your order if you are based outside of EU. 

If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by email about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. Fougett always reserves the right to cancel any order prior to our acceptance of the order. If we already have received payment for a cancelled order, we will refund the amount to you.

Please also note that Fougett may cancel the order even if it has been accepted by Fougett under the condition that you realise or should have realised that the price information was incorrect.

We are unable to offer price adjustments/price matching.

Please note that the delivery costs are not included in the prices for the goods. The delivery costs are shown in connection with the shipping methods at the checkout stage, and below in Section 10.

Please note, additional taxes and custom fees may be payable when you receive your order, depending on where you are shopping from. See section 9. 

 

8. Payments

Our payment provider is Shopify Plus, a payment service provided by Shopify International Ltd.

We accept the following payment methods:

When paying with a credit card, the purchase amount is reserved once you receive the order confirmation and is debited once Fougett has accepted your order by sending you the shipping confirmation.  

Please note that if you choose to pay by American Express, additional fees may be applicable. If this is the case, the additional fees will be stated at checkout.

Payments are made in Euro (EUR) for all shipments. 

If you wish to cancel your order, please contact us and we will issue a refund or cancel your invoice. Please note that we are unable to cancel an order once it has left our warehouse.

We are not responsible for any charges or penalties which may be imposed by the payment provider as a result of payment being processed in respect of your order.

9. Customs and duties 

Additional taxes and custom fees may be payable when you receive your order, depending on where you are shopping from.

Our orders are currently shipped from our warehouse in Sweden and United Kingdom. We ship all orders DDP (Delivery Duties Paid) to mainland Europe and within the UK. If for any reason you do receive a request from a shipping company to pay Sales Tax and Duty, please send us an email to info@fougett.com so we can pay and get your order on its way to you. 

United States and Rest of The World are shipped DDU (Delivery Duties Unpaid). Customs duties and taxes shall be invoiced once the item has cleared customs, either prior to or after delivery dependent on your location and you will be invoiced via the courier service. You, the customer, are liable for all local charges. 

Customers outside of the EU who return their orders for a refund are responsible for retrieving the local charges.  

It is a legal requirement that we declare the full value of the contents of all packages, so please do not request that we send a parcel without this. 

10. Delivery

Dispatch

At Fougett we endeavour to ensure that your order is delivered to you promptly via a reputable courier. We aim to dispatch within 1-2 working days of you placing your order, however, there might be slight delays during busier periods. Fougett is not responsible for any delays caused by customs clearance.

Shipping methods

Please note that we are unable to cancel an order once it has left our warehouse, that the shipping cost is non-refundable for returns and that delivery to rural addresses may result in longer delivery times.

The estimated delivery time does not consider possible delays caused by payment authorisation and/or stock availability. If Fougett fails to deliver within 30 days, you may have the right to cancel the purchase.  

Mainland Europe + UK shipping

Enjoy complimentary delivery on orders. Delivered within 3-7 working days.

Orders are shipped via a reputable courier and may require signature upon receipt. If you prefer to not sign the scanner, the courier may leave the shipment in a safe location and enter the full recipient’s name and proof of delivery. 

International shipping

Enjoy complimentary delivery on orders.

United States - Delivered within 3-7 working days 

Rest Of The World - Delivered within 5-10 working days 

International orders will be delivered within 3-10 working days of your order being placed. Orders are shipped via a reputable courier and will require signature upon receipt. If you prefer to not sign the scanner, the courier may leave the shipment in a safe location and enter the full recipient’s name and proof of delivery.

 

11. Right of withdrawal, returns and other rights

Withdrawal

You are entitled to withdraw your purchase or exchange your product by submitting or sending notice thereof to Fougett, shop@fougett.com, within 14 days of the date on which you have received the product. Please send us an email to the above-referenced email address including information that you will withdraw or exchange your purchase. If you send us an email, we will send you a confirmation upon receiving your notice. Please always refer to your order number in your communication with us. You may wish to keep a copy of your cancellation notification for your own records.

Refund relating to the right of withdrawal

If you choose to withdraw your purchase in accordance with the terms set forth in this section, Fougett will issue a refund of the amount paid to Fougett.

Fougett will pay the refund within 21 business days of the date on which we have received your notice of withdrawal, under the condition that Fougett has received the product/s from you or if Fougett has obtained proof that the products have been sent back to Fougett. The refund is made using the same payment method you used at the purchase if you do not explicitly accept another method. You will never be charged extra if another payment method is used.

Please note that Fougett only issues a full refund if the product/s are in the same conditions as at the time of delivery. If the products’ value has diminished due to your handling of the products to a greater extent than is necessary in order to ascertain its characteristics or function, you have an obligation to reimburse us. Thus, Fougett then has the right to withhold the amount of the refund.

To avoid a deduction, please make sure all products are in the exact same condition as when you received them, with tag and seal still attached. Please note that we do not accept returns or claims of Fougett items bought from other retailers or second-hand sites.

Shipping costs for returning the products

Please note that you must pay the shipping cost for returning the products in accordance with your right of withdrawal and exchange and Fougett has no obligation to pay such costs. Currently we do not cover the costs of returns and all returns costs are the responsibility of the customer.

Returns

Fougett.com accepts returns of unused, unworn, unwashed, unaltered, and undamaged items within 14 days of the item's ship date, provided that all original tags are attached. Please allow 21 business days for your refund to be processed. If your return does not meet the conditions listed, the package will be sent back to you. When your return has been accepted, your refund will be issued, and you will receive a confirmation email. 

 

If you wish to return or exchange an item, please email shop@fougett.com adding RETURN and Order Number in the subject line and we will assist you in making the return as easy as possible. Please place the product(s) in the original shipping box, or any other solid carton box and tape it securely. 

 

Currently we do not cover the costs of international returns and all returns costs are the responsibility of the customer.

Please note that the customer is responsible for any customs charges or import VAT incurred when returning item.

 

12. Defective products

If you receive defective products, please notify us immediately.

If Fougett consider the products to be defective, one of the following remedies may be applicable:

·       a full refund including shipping costs.

·       repair of the defective product.

·       replacing the defective product with a new product.   

 

13. Fougett's quality guarantee

Fougett acts in accordance with applicable consumer regulations. Please notify us as soon as possible after receiving defective products.

You are authorized to use this material only for personal, non-commercial purposes. Fougett reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the website.

20. Limitation of liability

If we fail to comply with these Terms and Conditions, we are liable for loss or damage which you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Fougett is not liable for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the order was made, both Fougett and you knew it might happen.

Unless expressly agreed otherwise, Fougett only supplies its products for domestic and private use. If you use any products purchased from Fougett for commercial, business or resale purpose, Fougett will have no liability to you for any loss of profit, loss of business, loss of anticipated savings, business interruption or loss of business opportunity.

Fougett’s liability to you will never exceed your total purchase amount for each order, unless otherwise stipulated by law.

21. Force Majeure

Fougett shall not be in breach of its obligations or otherwise liable for any failure or delay in the performance of its obligations if such delay or failure results from events, circumstances or causes beyond its reasonable control (a “Force Majeure Event”).

If a Force Majeure Event takes place, which affects the performance of our obligations under the Contract, we will contact you as soon as reasonably possible to notify you, and our obligations to you will be suspended and the time for performance of our obligations will be extended for the duration of the Force Majeure Event. Where the Force Majeure Event affects our delivery of Products to you, we will use reasonable endeavours to arrange a new delivery date with you after the Force Majeure Event has ceased.

If the period of delay or non-performance caused by the Force Majeure Event continues for 6 calendar months from the date of your order, you may cancel your order (see section 11).

22. Severability

Each of the paragraphs in these Terms and Conditions are intended to operate separately. If any part of these Terms and Conditions is held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms and Conditions.

23. Governing law and jurisdiction

These Terms and Conditions are governed by English law.

If you are a consumer, any Contract concluded under these Terms and Conditions – as well as any dispute or claim arising out of or in connection with such agreement – shall be governed by English law, provided that if you are not a UK resident, English law shall only apply to the extent that it is not overridden by any mandatory laws of the country in which you have your usual place of residence.

 

If any dispute or claim relating to an agreement under these Terms and Conditions arises:

(i)             if you are a consumer, you and Fougett both submit to the non-exclusive jurisdiction of the courts of England and Wales, although your legal right to bring an action against Fougett in the country in which you have your usual place of residence is not affected.

(ii)            if you are not a consumer, the courts of England and Wales shall have exclusive jurisdiction.

 

24. Additional terms

These Terms and Conditions shall not affect any rights you hold as a consumer under the applicable laws in the jurisdiction in which you reside.

Transfer of rights: We are entitled to transfer our rights and obligations to another organisation at any time. Should this occur, we will inform you in writing and ensure that such transfer does not affect your order(s).

You may not transfer any rights or obligations under these Terms and Conditions to another person, unless Fougett expressly agrees in writing.

Third Parties: These Terms and Conditions bind Fougett and you. No third party shall have the right to enforce any of these Terms and Conditions on your behalf.

Waiver: Any failure or delay on Fougett’s part to insist on performance of your obligations under these Terms and Conditions should not be construed as waiver of such, or that you are not required to satisfy those obligations. Fougett shall not be taken to waive any of its rights unless it does so expressly in writing.
